Terms and conditions of Pits-Burg

1. Scope

1.1 These general Terms and Conditions (hereinafter „T&Cs”) govern the contractual relationship between Pits-Burg as an Interest Community/aggregation of interest (hereinafter also referred to as Pits-Burg) and users of the website, customers purchasing event tickets through our website, and the bands as well as partners collaborating with Pits-Burg.

1.2 Deviating and or differing conditions of the customer are not recognized unless Pits-Burg has expressly agreed to their validity in writing.

2. Ticket Sales

2.1 Ticket sales take place through our website or authorised pre-sale outlets.

2.2 Customers can purchase tickets for events, subject to availability, following the „First Come, First Serve“ principle. There is no entitlement to acquire a ticket.

2.3 A contract between the customer and Pits-Burg is concluded upon the purchase of a ticket. The customer is obliged to pay the purchase price according to the specified payment methods.

2.4 Tickets are sent electronically or by post to the customer after successful payment. The customer is responsible for providing accurate contact information.

2.5 The customer is obligated to carefully check the received tickets for accuracy of information. Any discrepancies or errors must be reported to Pits-Burg without delay.

2.6 Ticket returns or exchanges are generally excluded, unless the event is canceled or significantly rescheduled. In such cases, legal provisions apply.

2.7 In case of ticket purchases by and or through an authorised pre-sale outlet, terms and conditions of that authorised pre-sale outlet may apply. 

3. Events

3.1 Pits-Burg assumes no liability for changes in the program or the performing artists that are beyond its control.

3.2 Pits-Burg reserves the right to cancel or reschedule events for important reasons. In such cases, Pits-Burg informs customers as early as possible and, if applicable, refunds the ticket price.

3.3 Outdoor events may experience changes or cancellations due to weather conditions. In such cases, Pits-Burg will inform customers in a timely manner and, if necessary, offer alternative dates or solutions, if feasible.

4. Digital and or hybrid events

4.1 Pits-Burg reserves the right to document events through video and publish the recorded material on YouTube, TikTok, or other platforms.

4.2 Pits-Burg has the right to reproduce and use the music used in digital events. The customer agrees that Pits-Burg may use the music for the stated purposes.

4.3 Pits-Burg assumes no liability for possible copyright infringements related to the use of music in digital and or hybrid events. The customer is responsible for ensuring that all necessary permissions for the use of the music are obtained.

5. Use of Photos and Videos

5.1 Pits-Burg reserves the right to take photos and videos at events and any events. These may be used for promotional and marketing purposes, including publication on all social media platforms.

5.2 By attending an event, the customer agrees that photos and videos featuring them may be used and published by Pits-Burg.

6. Liability

6.1 Pits-Burg and its vicarious agents/assistants are only liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded.

6.2 Pits-Burg is not liable for damages arising from force majeure or events beyond its control.

6.3 Pits-Burg assumes no liability for cloakroom or personal items handed in or brought to events.

7. Data Protection

7.1 Pits-Burg handles personal data confidentially and in accordance with applicable data protection regulations. Further information can be found in our Privacy Policy.

8. Donations

8.1 Pits-Burg is an organization/aggregation of interest/interest community that appreciates donations supporting its work. Donations are accepted and used in accordance with applicable laws.

8.2 Pits-Burg reserves the right to reject donations that contradict the organization’s goals and mission or violate applicable laws.

9. Volunteer Work

9.1 Pits-Burg welcomes and appreciates the support of volunteers. Volunteers work at their own responsibility and do not have an employment relationship with said organization.

9.2 Pits-Burg assumes no liability for damages or injuries occurring during voluntary work, unless gross negligence or intent on the part of Pits-Burg is proven.

10. Collaboration with Service Providers

The services of Pits-Burg may be provided in collaboration with various service providers. The following partners are involved in this cooperation:

1. Fotoatelier Kirwel: Responsible for photography services.

2. fünfunddreißig. Design: Responsible for graphic design.

3. Lukas Zeeh and Vestra Visuals: Responsible for videography services.

4. Infernal Audio & Gewaltmanufaktur: Responsible for recording, mixing, and mastering.

These service providers are independent companies working in partnership with Pits-Burg to provide a comprehensive range of services given their respective areas. Any contractual agreements and disclaimers regarding the services provided can be discussed directly with the respective service provider. Pits-Burg coordinates the collaboration and ensures that services are delivered in line with the individual requirements of our customers.

The respective service contract serves as the basis for the conclusion of the contract and acceptance of the service. Specific conditions and contract details may vary depending on the service provider and are outlined in separate agreements. Customers have the right to request additional information regarding the collaboration and associated services.

11. Final Provisions

11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 The place of jurisdiction for all disputes arising out of or in correlation with this contract is the registered office of Pits-Burg, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.
